DO’S AND DON’T’S WHEN
ARRESTED or FACING ARREST
When arrested or facing arrest the following is a guide to the
DO’S
AND DON’TS. The way you conduct yourself during this period
can be critical to the outcome of your case.
Here is a list of the things YOU SHOULD DO:
Remain
silent, and be polite and respectful towards law enforcement.
Contact your attorney or ask for one, and remain silent until one
is present.
Try to get badge numbers and the number of the patrol vehicle of the arresting officers.
If injured, get pictures and medical attention ASAP.
Try to find witnesses and get their contact information.
Have your lawyer present at any questioning or line-ups.
If police come to your home, you may not have to let them in unless
they have warrants. And, stay inside because they may be able to
arrest you outside of your home without a warrant
Here is a list of the things you SHOULD NOT DO:
Do
not try to avoid arrest by running or hiding. This will look bad
to the court.
Do not be rude or disrespectful to arresting officers.
Do not offer the police permission to search anything.
Do not try to resist arrest even if you know you are innocent.
Do not physically touch the police.
Do not talk to anyone about your arrest such as cellmates if you
are held in custody.
Do not answer questions even from law enforcement until your attorney
is present.
Do not give the police permission to enter your house without a
warrant.
Do not believe what the police tell you in order to try to make
you talk. Wait for your attorney to be present before they interrogate
you.
